1. Scope of Application
These General Terms and Conditions (T&C) apply to all contracts between the Horizont Electronic Vertriebs GmbH & Co. KG (hereinafter "we") and our customers.
They apply to both consumers (§ 13 BGB) and entrepreneurs (§ 14 BGB). The version of these T&C valid at the time of conclusion of the contract is decisive.
Individual agreements take precedence (§ 305b BGB).
2. Contract Formation
2.1 Product Representations
Product images and descriptions are non-binding and do not constitute an offer, but an invitation to submit an offer (invitatio ad offerendum).
2.2 Contract Formation with Consumers (B2C)
- Offer: By clicking "order with payment obligation" you submit a binding offer.
- Order Confirmation: The automatically sent order confirmation only confirms receipt of the order and does not yet constitute acceptance.
- Acceptance: The contract is concluded when we explicitly accept your order by email or dispatch the goods.
- Storage: The contract text will be saved and sent to you by email.
2.3 Contract Formation with Entrepreneurs (B2B)
By placing your order you submit a binding offer which you are bound to for 14 days.
Acceptance occurs through: written order confirmation by email, dispatch of goods or performance of services.
3. Service Description / Location Services
3.1 How Location Works
The accuracy of location data depends on various factors:
- GPS signal quality
- Mobile network coverage
- structural conditions (e.g. buildings, tunnels)
- Weather influences
4. Device Models – Rental & Purchase Model
4.1 Rental Model
In plans with a rental GPS tracker, the device remains the property of the provider throughout the contract period. The customer receives a time-limited right of use.
4.2 Purchase Model
For purchased GPS trackers, ownership is transferred to the customer upon full payment of the purchase price in accordance with § 929 BGB. In this case, there is no obligation to return the device.
The tracking service is an independent service.
The SIM card must be returned upon termination. If the SIM card is not returned, a flat fee of €20.00 incl. VAT will be charged.
4.3 4G Smart Package GPS Tracker for Vehicles – without Subscription
The tracking system is purchased and used once – without a monthly contractual commitment. The GPS tracker includes a pre-installed, activated SIM card and is ready for immediate use.
Included in the purchase price:
- 4G GPS tracking unit
- Integrated SIM card
- 12 months EU data flat rate (Europe-wide, 500 MB for tracking services)
The tracking service runs on a time-limited license and is not a permanently guaranteed service.
Important:
The customer must take care of the extension or cancellation themselves at least 15 days before the license expires. Without timely feedback, the service will be permanently and irrevocably deactivated after expiry.
License extension in the shop:
- Term: 12 or 24 months
- Start of license: 5 days after invoice date
4.4 2G GPS Tracker for Vehicles – without Subscription & with Subscription
2G Network Shutdown: The 2G network in Germany will be shut down by June 30, 2028 at the latest (possibly earlier).
Use: Use of the tracker is possible without restriction until shutdown.
Smart Package: 500 MB data volume included.
Optional additional data volume: 500 MB for €20.00 incl. VAT.
5. Contract Term & Cancellation
The minimum contract term is 3 months.
After the minimum contract term, the contract can be terminated with one month's notice to the end of the month.
7. Prices & Payment Terms
All prices include statutory value added tax.
7.1 Billing
The monthly service fees are billed semi-annually in advance (6 months).
8. Right of Withdrawal for Consumers
Consumers have a statutory right of withdrawal of 14 days (§§ 312g, 355 BGB).
9. Warranty
For Consumers (B2C)
- 24 months statutory warranty
- 12 months reversal of burden of proof (§ 477 BGB)
For Entrepreneurs (B2B)
- 12 months warranty
- Inspection and notification obligation pursuant to § 377 HGB
